Developments in the law and the regulatory regime have increased the exposure of regulated healthcare companies to the risk of incurring substantial costs in dealing both with investigations into the care they provide and potential criminal prosecution.
The Corporate Manslaughter and Corporate Homicide Act which came into effect in April 2008 created a new offence – corporate manslaughter, which means that companies who cause death by gross negligence can be prosecuted. Because of the likely complexity of any such proceedings, the legal costs will be correspondingly high.
From April 2009 independent healthcare services must be registered with the Care Quality Commission and demonstrate that they continue to meet essential, common quality standards. The Commission have a wide range of investigative and enforcement powers including suspension or closure of the service and removal from the register.
